CONDITIONS OF HIRE
1 BOOKING. A boat is not booked
until the completed and signed Booking Form together with
a deposit of approximately one third of the total Hire
charge has been received by the Company and confirmed in
writing.
2. BALANCE OF HIRE CHARGE. The Hirer, upon
making a booking becomes responsible for the whole of the
Hire Charge and the balance must be paid 6 weeks before
the commencement of the Cruise. No reminders will be sent other than
invoice on receipt of deposit.
3. CANCELLATION. Should the Hirer wish to cancel
the booking he/she shall immediately notify the Company and
return the confirmation. If the hirer has joined our cancellation scheme
and qualifies he/she will be refunded for the full cost of the holiday
(minus 1/6th of hire fee for administration costs), otherwise he/she is still
responsible for the entire cost of the holiday and is advised to claim
on his/her own holiday insurance.
4. HIRERS. Bookings will not be accepted from
Hirers under 18 years of age. Mixed parties preferred.
5. ANIMALS AND BAIT. House-trained pets only may be brought. Live bait may
not be taken on board without prior arrangement with the
Owners.
6. RETURNABLE DEPOSIT. A total sum of £100 per
booking is added to all cruise accounts as a damage and
accident deposit. During the week following the cruise
this sum will be returned to the Hirer less any
deductions in respect of loss or damage. Late return of boats are
charged at £20 per hour and excessively dirty condition charged
accordingly.
7. BOOKING PERIOD. Boats are booked from
Saturday approximately 2.30 p.m. returning at 9.00
a.m. the following Saturday, except 'Mallard' -2.00
p.m. Friday, returning 9.00 a.m. Friday.
8. RETURN OF BOATS. Boats must be returned
at the end of the cruise in a clean condition and
vacated at the agreed time and place. The Hirer is
responsible for allowing sufficient margin of time for
contingencies. The Company reserves the right to claim
£20.00 per hour from the Hirer for late return, plus any
additional expenses incurred by the Company as a result
of the late return.
9. INSURANCE. Insurance of the boat and the
hirer's liability to other parties (up to £1,000,000)
included in the Hire Charge. Hirer's personal effects are
not covered by this insurance.
10. EQUIPMENT. The Hirer undertakes to report,
and may be requested to pay for any equipment lost,
broken or stolen or damaged. Unsuitable substitutes are
not accepted.
11.
ACCIDENTS. The Hirer must report immediately by telephone
to the Company any accident to the boat or its equipment
or to waterway property, whether or not other boats are
involved and shall proceed as instructed by the Company.
The Hirer shall not at any time admit to any liability
for any accident to any third party and shall not put any
repairs into the hands of any firm without the Company's
permission.
12. NAVIGATION. No boat may tow another, travel
after sunset or before sunrise, or navigate any tidal
waters without prior written permission of the Company.
The Hirer shall at all times comply with instructions
given to him by the Company or the Waterways Authority.
13. AVAILABILITY OF CRAFT. If due to
circumstances beyond its reasonable control such as flooding or
significant damage, the Company
is unable to provide the Hirer with the boat booked or a
suitable alternative, alternative dates of the same value will be
offered but no refund will be given.
14. HIRER'S PROPERTY. The Company accepts no
liability for any loss or damage to Hirer's property
whilst upon the craft or premises of the Company, however
caused.
15. RESTRICTED CRUISE. The Company accepts no
liability and shall not be bound to make any financial
adjustment in the event of cruising waters being
restricted through repair works, floods, drought or any
other cause beyond the control of the Company.
16. BREAKDOWN. The Hirer shall have no claim
upon the Company as a result of any breakdown or failure
of its engine or equipment. Where such breakdown is
caused by negligence of the Hirer, the Company shall have
the right to claim upon the Hirer in respect of expenses
involved in rectifying the matter.
17. INSTRUCTION. No boat will be allowed out to
new clients until instruction has been given. In the
interest of safety, the Company reserves the right not to
hand over the boat to anyone whom it deems unsuitable due
to ill health, disability, inexperience or any other
reason when to do so would in the Company's opinion lead
to a serious risk of accident or damage.
18. WEBSITE. All descriptions and diagrams are
generally accurate, however the Company cannot be held
responsible for minor inaccuracies.
